Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the BLUEcollar mobile application and website ("App" or "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

BLUEcollar is a certification management and presentation tool designed for skilled trade workers. The App allows you to:

• Store and organize professional certification cards
• View your certifications in a digital format
• Share certifications via email when you choose
• Back up your certification data securely to the cloud
• Track certification expiration dates
• Receive renewal reminders
• Generate supervisor reports

3. Important Limitations

Not a Replacement for Original Documents

The App is a record-management tool only. You must:

• Retain all original certification documents
• Present original documents when required by law or regulation
• Not rely solely on the App as proof of certification for legal purposes
• Understand that digital copies may not be accepted in all situations

No Government or Legal Affiliation

BLUEcollar has NO affiliation with:

• Ontario Ministry of Labour or Health & Safety Ontario (OHSA)
• Any federal or provincial government regulatory body
• Certification issuing authorities
• Union organizations (IBEW, LIUNA, etc.)
• Professional licensing boards

4. Your Responsibilities

Account Security

• Maintain the confidentiality of your login credentials
• Use a strong, unique password (minimum 8 characters)
• Notify us immediately of unauthorized account access
• Not share your account with others
• Log out when using shared devices

Accurate Information

• Provide accurate and truthful information during registration
• Only upload certifications that belong to you
• Keep your profile information current
• Update information when circumstances change

Lawful Use

You agree to use the App only for lawful purposes:

• Use the App only for legitimate professional purposes
• Not misrepresent your qualifications or certifications
• Not use false or fraudulent certifications
• Not attempt to bypass security measures
• Comply with all applicable laws and regulations

Prohibited Activities

You must NOT:

• Upload, store, or distribute fraudulent or falsified certifications
• Use the App for identity theft, fraud, or deception
• Attempt to hack, reverse-engineer, or compromise the App
• Distribute malware or viruses through the App
• Violate any applicable laws, regulations, or third-party rights
• Spam, harass, or threaten other users
• Use automated tools to access the App without permission

5. Data Ownership

Your Data Ownership

You retain full ownership of all certification data and images you store in the App. We do not claim any rights to your data.

License to BLUEcollar

By using the App, you grant BLUEcollar a limited license to:

• Store your data on our secure servers
• Process your data to provide the service
• Transmit your data when you request sharing (e.g., email)
• Back up your data for safety and recovery
• Analyze data for service improvement (with your consent)

This license terminates immediately when you delete your account.

6. Limitation of Liability

Disclaimers

Limitation of Damages

To the maximum extent permitted by law, BLUEcollar is not liable for:

• Any indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Damages resulting from your use of or inability to use the App
• Damages from unauthorized access to your account
• Consequences of rejecting your digital certifications

Data Loss

While we maintain backups, we are not responsible for:

• Data loss resulting from user error
• Loss of data due to account deletion
• Inability to recover deleted data after 30 days

Always maintain copies of your original certification documents.

7. Account Termination

Your Right to Delete

You may delete your account at any time through Settings → Privacy & Data → Delete Account. This action:

• Permanently removes all your data from our servers
• Cannot be undone
• Takes effect within 30 days
• Removes your access to the App

Our Right to Terminate

We may suspend or terminate your account if:

• You violate these Terms of Service
• You use fraudulent or falsified certifications
• You attempt to hack or compromise the App
• Your account is inactive for more than 12 months
• You engage in illegal activities

We will provide notice of termination where legally required.

8. Third-Party Services

The App uses third-party services including Firebase, Google Cloud, and SendGrid. These services have their own terms of service and privacy policies. Your use of the App means you agree to these third-party terms as well.

We are not responsible for any issues or outages with third-party services.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of any material changes by:

• Posting the updated Terms on our website
• Sending an email notification
• Displaying a notice in the App

Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
